Article 3 - Applicability
These General Terms and Conditions apply to any offer made by the entrepreneur and to any distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the conclusion of the distance contract that the General Terms and Conditions can be reviewed at the merchant’s location and that they will be provided to the consumer free of charge upon request.
In the case of an electronic conclusion of the distance contract, the text of these General Terms and Conditions will be made available to the consumer electronically before the conclusion of the distance contract, in a manner that allows the consumer to store it easily on a durable medium. If this is not reasonably possible, it will be indicated before the conclusion of the distance contract where the General Terms and Conditions can be reviewed electronically, and that they will be provided to the consumer electronically or otherwise free of charge upon request.
If specific product or service conditions apply in addition to these General Terms and Conditions, paragraphs 2 and 3 will apply accordingly, and the consumer can always invoke the most favorable provision in case of conflicting General Terms and Conditions.
Matters not covered by these General Terms and Conditions will be judged “in the spirit” of these General Terms and Conditions.
Any ambiguities regarding the interpretation or content of one or more provisions of our General Terms and Conditions will be interpreted “in the spirit” of these General Terms and Conditions.
Article 4 - The Offer
If an offer has a limited validity period or is made under specific conditions, this will be explicitly stated in the offer.
The offer is subject to change. The entrepreneur has the right to modify and adjust the offer.
The offer includes a complete and accurate description of the products and/or services offered. The description is detailed enough to allow the consumer to assess the offer properly. If the entrepreneur uses images, these will be a truthful representation of the products and/or services offered. Obvious mistakes or errors in the offer do not bind the entrepreneur.
All images, specifications, and data in the offer are indicative and cannot serve as a basis for compensation or contract cancellation.
The images of the products are a true representation of the offered products. The company cannot guarantee that the displayed colors exactly match the actual colors of the products.
Each offer contains information from which the consumer can understand the rights and obligations associated with the acceptance of the offer. This includes, in particular:
- The price, excluding customs and VAT on imports. These additional costs are borne by and at the risk of the customer. The postal and/or courier service uses the specific regulation for postal and courier services on imports. This regulation applies when the goods are imported into the EU country of destination, which is the case here. The postal and/or courier company collects VAT (also concerning customs clearance costs) from the recipient of the goods.
- The shipping costs, if applicable.
- The method of concluding the contract and the steps required for its conclusion.
- Whether the right of withdrawal is applicable or not.
- The payment method, delivery, and execution of the contract.
